Terms of Use

The conditions governing access to ashram.live, to the community and to the Ashram online service.

1. Acceptance

By creating an account, accessing the site or playing Ashram you accept these Terms of Use. If you do not agree with them, do not use the service.

The service is provided by Brainsoft Games ("Brainsoft"), developer and operator of Ashram. The licence for the client software is additionally governed by the End User Licence Agreement (EULA), and the processing of your data by the Privacy Policy. The three documents complement one another.

2. Who may use the service

You must be at least 16, or the minimum age set by the law of your country if different, with the authorisation of a parent or guardian where such authorisation is required.

You are responsible for the accuracy of your registration details and for safeguarding your credentials. All activity carried out from your account is presumed to be yours. Tell us immediately at llboom@brainsoft.games if you suspect unauthorised access.

3. Your account

  • An account is personal and non-transferable. It may not be sold, rented, assigned, shared or traded.
  • You do not acquire ownership of the account: you obtain a right of access, revocable in accordance with these terms.
  • You may delete your account at any time from the site or by writing to us. Deletion is permanent.
  • We may suspend or close an account that breaches these terms, with prior notice except where the seriousness or urgency of the breach does not allow it.

4. Prohibited conduct

When using Ashram you undertake not to:

  • Use cheats, bots, macros, third-party programs or any method that alters the normal operation of the game.
  • Exploit game bugs for your benefit instead of reporting them.
  • Trade accounts, characters, items or in-game currency for real money or other consideration outside the service.
  • Harass, threaten or impersonate other users, or disclose their personal data.
  • Publish unlawful content, extreme violence, sexual content involving minors, hate speech, or content that infringes third-party rights.
  • Reverse engineer, decompile or modify the client, except to the extent mandatorily permitted by law.
  • Attack, overload or interfere with the service infrastructure, or attempt to access unauthorised areas.
  • Automate bulk extraction of data from the site without our written permission.

5. Items, progress and the in-game economy

Characters, items, currency and any other in-game element are licensed content, not goods you own. They have no monetary value outside the game, cannot be exchanged for money, and may be modified, rebalanced or withdrawn where game design or balance requires it.

None of the above affects the rights consumer law grants you over purchases made with real money, if any.

6. Beta phase and availability

Ashram is under active development. The service is provided "as is" and "as available": there may be bugs, outages, scheduled maintenance and content changes without prior notice.

During the beta, progress resets (wipes) may occur where necessary for technical or balance reasons. We will announce them as far in advance as possible.

We do not guarantee uninterrupted availability nor indefinite preservation of the service. Should we decide to shut it down, we would announce it with reasonable notice.

7. Intellectual property

Ashram, its code, art, music, texts, trade marks and its universe as a whole belong to Brainsoft or its licensors and are protected by intellectual and industrial property law.

You are permitted to capture screenshots and record video of your sessions and to publish them, including on monetised channels, provided you do not imply that Brainsoft sponsors your content and you do not use it for unlawful activities. That permission is revocable.

8. Content you publish

You retain ownership of what you upload. By publishing it in the community you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display it within the service, for the sole purpose of operating it.

You are solely responsible for the content you publish. The specific rules and the removal procedure are set out in the User Content notice.

9. Warranties and liability

The service is provided without warranties beyond those mandatorily imposed by law. We do not warrant that the game is free of errors or that it will meet particular expectations.

To the extent permitted by law, Brainsoft shall not be liable for indirect damages, loss of profit, or loss of data or progress arising from use of the service.

Nothing in these terms excludes or limits our liability for wilful misconduct, gross negligence, death or personal injury, or any other liability that may not lawfully be excluded. If you are a consumer in the European Union, your statutory rights remain unaffected.

10. Changes to the terms

We may amend these terms for legal, technical or operational reasons. We will publish the updated version with its date and, if the change is substantial, we will give you at least 15 days notice. If you do not accept the change, you may stop using the service and delete your account.

11. Governing law and dispute resolution

These terms are governed by Spanish law, without prejudice to the mandatory consumer protection rules of the user’s country of habitual residence within the European Union.

If you are a consumer, you may use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr. Before that, we would appreciate an email to llboom@brainsoft.games: most problems are solved in one message.
