1. What this notice covers
The ashram.live community lets users publish text, comments and images. That content is created and uploaded by them, not by Brainsoft Games.
Brainsoft acts as a hosting service provider within the meaning of Article 6 of Regulation (EU) 2022/2065 (Digital Services Act). We do not generally monitor what is published, nor are we obliged to (Article 8 of the same Regulation), and we act diligently as soon as we obtain actual knowledge of illegal content.
2. Responsibility of the person posting
Whoever uploads content is its sole responsible party, for all legal purposes. By publishing, you represent and warrant that:
- You own the rights in the content, or you have sufficient authorisation from whoever does.
- The content does not infringe third-party intellectual property, industrial property, image, honour or privacy rights.
- The content is not unlawful under applicable law and does not breach the rules in section 3.
- Where identifiable people appear, you have their consent to publish their image.
Anyone who publishes unlawful content shall be liable to affected third parties and to Brainsoft for the damages, penalties and defence costs that such content causes us.
3. Prohibited content
The following must not be published, in any format:
- Child sexual abuse material or any sexual content involving minors. It is removed immediately and reported to the authorities.
- Content inciting hatred, violence or discrimination on grounds of race, origin, religion, sex, sexual orientation, gender identity or disability.
- Threats, harassment, or incitement to suicide or self-harm.
- Extreme violence or gratuitous gore, and sexually explicit content.
- Third parties’ personal data without their consent (doxing).
- Copyright-protected works you are not licensed to use.
- Terrorist propaganda, glorification of crimes or instructions to commit them.
- Scams, phishing, malware, unsolicited advertising, and the sale of accounts or items for real money.
- Impersonation of other users, of the Ashram team or of third parties.
4. Moderation
Uploaded images are analysed automatically before publication to detect nudity and explicit content. That filter is an aid, not a guarantee: it does not replace human judgement, nor does it ensure that everything passing the filter is lawful.
When an image is reported it is analysed again and, if the breach is confirmed, the post, its comments and the stored file are deleted, with the reason recorded.
Video is not analysed automatically: only format and size are checked. Video moderation depends entirely on reports.
5. How to report content
Anyone, with or without an account, may report content they consider unlawful. Use the report button on the post or write to llboom@brainsoft.games stating:
- The exact link to the post, comment or image.
- Why you consider it unlawful, explained clearly enough to be understood.
- Your name and a contact email address, unless the report concerns offences against minors, in which case it may be anonymous.
- A statement that you believe in good faith that the information in the report is accurate and complete.
We acknowledge receipt without delay and communicate a reasoned decision to both the reporter and the person who posted, indicating the available redress mechanisms, in accordance with Articles 16 and 17 of the Digital Services Act.
6. Copyright infringement notice
If you are a rights holder and believe published content infringes your rights, write to llboom@brainsoft.games identifying the protected work, the link to the infringing content and your contact details, with a statement that you act in good faith and are authorised to act on the rights holder’s behalf.
We remove the content as soon as we verify the notice. The person who posted it may submit a counter-notice if they consider the removal unjustified.
7. Consequences and redress
Depending on severity and repetition, measures range from removing the content to temporary suspension or permanent closure of the account. Accounts that repeatedly and manifestly infringe are closed, in accordance with Article 23 of the Digital Services Act.
If you believe a moderation decision was wrong, you may appeal within the following six months by writing to llboom@brainsoft.games. Every review is carried out by a person, not by an automated system. You also retain the option of an out-of-court dispute settlement body or the courts.
